When Oversight Stops Working

The real danger isn’t the law. It’s what happens when power decides the limits no longer apply.

What happens when the people holding power decide the limits no longer apply?

Americans are constantly told not to worry when new government powers appear. The reassurance always sounds the same. There are safeguards. There is oversight. Inspectors general exist to investigate abuses. Congressional committees monitor the system. Courts remain available if something crosses the line.

On paper, that sounds responsible and orderly.

But that reassurance rests on an assumption that many Americans no longer accept without question: that the institutions responsible for enforcing those limits will actually do so when it matters.

The real issue is not whether a directive or law contains oversight language. Nearly all of them do. The real question is whether anyone exercising that power still feels bound by those limits once fear, crisis, and political pressure enter the equation.

History suggests that answer is far less comforting than the official explanation.

Crisis Is When Governments Test Their Limits

The United States has repeatedly expanded government authority during moments of national crisis. Each time those expansions occur, the same assurances accompany them. Officials emphasize that the measures are temporary, carefully supervised, and necessary to address extraordinary threats.

In many cases, those assurances later proved overly optimistic.

During World War II, the federal government forcibly relocated and incarcerated more than 100,000 Americans of Japanese ancestry. At the time, the policy was justified as a national security necessity. Only years later did the country widely acknowledge that the safeguards meant to protect civil liberties had failed to stop one of the most sweeping violations of constitutional rights in American history.

After the attacks of September 11, the government dramatically expanded surveillance authorities in the name of counterterrorism. Americans were told these powers were essential to prevent further attacks. Over time, disclosures revealed intelligence programs that extended far beyond what the public initially believed had been authorized.

The pattern is difficult to ignore. In moments of perceived emergency, government authority expands rapidly while meaningful scrutiny often arrives much later.

COVID Showed How Quickly Assumptions Can Change

Reasonable people can debate whether every decision made during that period was justified. What is much harder to debate is how rapidly long-standing assumptions about liberty changed once governments declared a crisis.

Freedoms that had been treated as fundamental for generations suddenly became conditional.

For many Americans, that experience fundamentally changed how they interpret government assurances that new powers will remain carefully limited.

The Problem Isn’t The Document

Whenever new authorities appear, analysts often focus on the language of the document itself. They parse definitions, analyze clauses, and debate exactly what powers have been granted or restricted.

That analysis is useful, but it often overlooks the deeper issue.

Institutions rarely interpret their own authority narrowly when circumstances allow a broader interpretation. Bureaucracies tend to expand their power over time. Political leaders facing crises often prioritize immediate action over long-term constitutional caution.

Oversight mechanisms are supposed to counterbalance those tendencies. But oversight only works when the people responsible for enforcing it are willing to challenge the institutions they oversee.

History shows that willingness can fluctuate dramatically depending on political pressure, public fear, and the perceived severity of the threat.

Why Americans Are Skeptical

Each episode reinforces the same lesson: written safeguards only matter when the people responsible for enforcing them remain willing to do so.


The Debate That Actually Matters

The most important debate surrounding national security authorities is not simply what a directive says. It is whether the system designed to restrain power still operates the way Americans expect it to operate.

If oversight institutions remain independent and assertive, broad authorities can coexist with civil liberties protections. If those institutions weaken or become reluctant to challenge power, even narrowly written authorities can gradually expand beyond their original intent.

That tension between liberty and security has existed since the founding of the United States.

Pretending that oversight language automatically resolves that tension does not make it go away.

Psalm 62:1-12

(1) Truly my soul waiteth upon God: from him cometh my salvation. (2) He only is my rock and my salvation; he is my defence; I shall not be greatly moved. (3) How long will ye imagine mischief against a man? ye shall be slain all of you: as a bowing wall shall ye be, and as a tottering fence. (4) They only consult to cast him down from his excellency: they delight in lies: they bless with their mouth, but they curse inwardly. Selah. (5) My soul, wait thou only upon God; for my expectation is from him. (6) He only is my rock and my salvation: he is my defence; I shall not be moved. (7) In God is my salvation and my glory: the rock of my strength, and my refuge, is in God. (8) Trust in him at all times; ye people, pour out your heart before him: God is a refuge for us. Selah. When a person is in ordinary trouble and needs help, does he not seek out someone who has more of whatever it takes to help him overcome his situation? The need may be as simple as an additional hand or a bit more physical strength, or it could be something more complex like wisdom, a specialized skill, practical expertise, or community influence. The helper’s power may simply be that he or she has more experience in the area of need. The need may be legal, so contacting a lawyer is a wise move. If the need is medical, seeing a doctor makes sense. One would consult an auto mechanic if the car needs to be repaired, etc. We frequently seek the powers of others.

Psalm 62 instructs us that the supreme power in all creation is God. In verse 1, David begins to express this fact by saying that from God comes salvation, that He is our Deliverer from trouble, implying that it should be to Him that we run. In verse 2, God is our rock, meaning our foundation and source of stability, who keeps us grounded and free from unreasonable anxieties. He is also our defense; He can deflect attacks in ways humans cannot provide.

Verses 3-4 are said to David’s attackers, who were attempting to undermine his reputation before the public while also seeking a way to assassinate him. He warns them that their lies will prove to be their undoing.

In verses 5-7, David turns his attention back to himself, trying to encourage himself by resolving to wait patiently upon God as his only trustworthy hope. In verse 7, he reminds us that God is our glory: We take pride in Him for all that He is. He can give us favor even before those who may be against us. He is our refuge, an unqualified place of safety in any circumstance. In verse 8, he exhorts others – friends, companions, and supporters – urging them to pray because God is a solid place of refuge in our times of trouble.

Five times in this brief, twelve-verse psalm, he exhorts himself or instructs us that God is the only sure place of refuge and of help in times of need. How can God be and do all these things? David names Him as our Rock, Salvation, Defender, Refuge, and Glory. He can hold all these titles because, as David says simply in verse 11, “Power [or strength] belongs to God.”

This confronts us with a major reason why God is the only One we can rely on fully in our time of need. Power is not only something God possesses, but when we come to understand it, all power belongs to Him. All power flows from Him, and He gives it to whomever He will. God not only has power as a possession, but He can use it in any situation or distribute it as He sees fit! Who can fight God or gainsay His choice of whom He chooses to give it to? Who has sufficient power to nullify God’s doing of anything He desires to accomplish?

Notice that in Psalm 62:11 the word “belongs” is in italics, meaning it was added by the translator. It is not a wrong addition but appropriate. It is as though He owns it; it is His to use and/or distribute as He alone sees fit. It begins to open an awesome thought to consideration: Nobody has power unless God provides it for his use.

Understanding this truth makes David’s exhortation in verses 9 and 10 more understandable. Compared to God, men are so puny as to be nothing. They may appear strong on the surface, but with our powerful, trustworthy Resource, we do not have to retaliate stupidly or be overwrought by anxiety.

This powerful Being is on our side by His choice! We have not earned it.

At the height of the farm crisis of the 1980s, Wendell Berry wrote in a new foreword to the “The Unsettling of America”: “Farmers are losing their farms, some are killing themselves, some in the madness of despair are killing other people, and rural economy and rural life are gravely stricken. … We are closer every day to the final destruction of private ownership not only of small family farms, but of small usable properties of all kinds.” 

The great “unsettling” detailed in Berry’s book unfolded as agriculture became industrialized in the 1970s and 1980s and government policy pushed farmers to scale their operations and produce larger yields per acre. As a result of the spiraling cycle of rapid expansion and the implementation of factory-style farming techniques, fewer farmers did more work with greater debt loads. Then, in the 1980s, an increase in interest rates, a drop in exports, and a plummet in land and crop prices pulled the rug out from under the whole unstable system. 

Many farmers went bankrupt, and farming families were displaced from their farms and driven to the cities by economic necessity. With the evaporation of small family farms and the corporatization of large ones, economic opportunity in rural America dwindled. 

There was no longer a sufficient population nor sufficient economic health to maintain local economies. Many small rural towns became virtual ghost towns as a result. Their once-vibrant main streets consist of boarded-up, disheveled, and dilapidated old buildings standing blankly beside an empty street, a kind of architectural cemetery of a past America. 

Commenting on that collapse, business consultant, entrepreneur, and Iowa native Danna Larson told The Epoch Times, “The farm crisis was devastating to rural America, especially the Midwest, and it left a lot of people with no option but to leave.”
